So, remember how I was all excited about buying an IBM USB Trackpoint keyboard off of eBay about two weeks ago?

Well turns out the Trackpoint behaves too erratically to be usable. I've updated the drivers, tweaked the settings, called tech support but nothing works.

I contacted the seller (who has 100+ 100% positive reviews) numerous times over a two week period who has finally responded with:

As a private seller, and not an online business, I cannot afford to indemnify buyers against damages cause either in transit or in your person. I asserted in the auction that the item was in top working condition, but that sale of the keyboard was "as-is". This is reflected in the extremely low price you paid for the item - less than half its retail value.

And since I don't have an original receipt for this thing I cannot get it warrantied with IBM. (Anyone want to photoshop me a receipt?)

My ideal resolution to this problem would be returning the item to the seller. So I proposed returning the item to the seller because if the item is stlil in top condition he can re-sell it. If the item was in top condition but is now not, then it was damaged either in shipping (appropriate packaging is of course the shippers responsibility, especially when they charge you over double the cost of actual postage) or I damaged it (this is unlikely since I sent him an email about the Trackpoint problem within an hour of receiving the item). But apparently he is not interested in this resolution.

I understand the item was sold 'as-is' but the auction clearly stated it was in top condition, which it is not. So what should I do now? (PayPal - Buyer Complaint Proces, Online Fraud Complaint Reporting Form, resell it 'as-s', charge back the paypal charge, suck it up...?) What would you do?
