Webnoize: New P2P Services May Force Courts to Reevaluate Liability Notions

The article looks at 'tertiary infringers', A tertiary infringer would be one who has knowledge of and contributes to the acts of a contributory or vicarious infringer, or one who supervises and financially benefits from a contributory or vicarious infringer.

In Canada we don't have 'contributory infringement' and I assume it'll be a while before we catch onto the idea of 'tertiary infringement'. None the less the very idea of tertiary infringement makes my blood boil. Imagine the RIAA going after developers who develop general purpose p2p software because it could be potentially used to pirate music. Scary thought. Or maybe one of my weblogger friends would be guilty if they linked in their weblog to music on my server.

Let's for a moment consider the murder industry. When I murder someone who do the authorities go after? Do they go after the gun manufacture or do they go after me? Now of course the murder industry has laws about accomplices which would be akin to contributory infringement which on some levels I agree with but in the way it was used in the Napster case I definitely disagree.

I'm installing Win2k on the new notebook and Microsoft just popped up a dialog box asking for files for some plug in play devices. On the list is this:

Microsoft Kernel DRM Descrambler Filter (not currently present)

WTF is a DRM Descrambler and why would I ever want one?

I was just about to post a snarky remark about how the Dell status page wasn't displaying my notebook order (ordered last Thursday) when surprise, surprise it arrived today!!

I was looking forward to my shrimp pizza leftover from last night but upon opening the doggy bag (I just spent 10 minutes looking for a link to the article on... never mind I just found it (doggy vs. doggie): Doggie-bag use climbing) I discovered that they [Milestone's Bar & Grill] had put my pizza with my sisters salad! Pizza and salad in the same container just don't mix unless you like soggy pizza. I'm so upset (and hungry!). If I had a printer I'd fire off a letter of complaint right now.

On that note, Doc points to a letter of complaint to Chapters. I like the idea of publishing both the letter and their response online and in your blog. Once re-united with my printer expect a flood of letters to airlines, banks, and cell companies.

Boo.com the movie. I wanted to say more but really can't.
